Zoning Changes & Relief

In the event that zoning regulations prohibit an aspect of your project and you are unable to make the necessary adjustments, you may need to seek Zoning Relief of one form or another. Continue reading below for more information, and as always, don't hesitate to contact us for more assistance.

 

Map Amendments

A Map Amendment, also referred to as a Rezoning, is a change to the Zoning District mapped to a property. You must meet certain minimum requirements in order to be eligible to apply for a rezoning.

If you wish to pursue a Map Amendment, we strongly recommend that you contact us to set up a pre-application conference so that we can discuss your options. At minimum, a Map Amendment requires a hearing before the Planning Commission as well as a Zoning Public Hearing and two affirmative readings at City Council.

Special Exceptions

Certain uses or characteristics of use are allowed only if the Board of Zoning Appeals (BoZA) approves a Special Exception within a given Zoning District. In order to be granted a Special Exception, the Board must find that your application meets certain general criteria and/or additional specified criteria for the particular use.

Variances

If, due to special conditions, a literal enforcement of the Zoning Ordinance will result in unnecessary hardship, you may request a variance from the Board of Zoning Appeals. In order to be granted a Variance, the Board must find that your property has an individual case of unnecessary hardship and that your application meets certain conditions.

Administrative Appeals

Appeals to the board of zoning appeals may be taken by any person aggrieved or by any officer, department, board or bureau of the city affected by any decision of the zoning administrator. That appeal shall be taken within 30 days by filing with the zoning administrator from whom the appeal is taken and with the board of zoning appeals a notice of appeal specifying the grounds thereof.

Nonconforming Uses or Structures

Nonconforming Uses or Structures are also commonly referred to as being "Grandfathered". It is the intent of the Zoning Ordinance to permit these non-conformities to continue until they are removed, but not to encourage their survival.
