CITY COUNCIL CHAMBERS

The City of Columbia City Council will meet in Regular Session on Wednesday, November 14, 2001 in the City Hall Council Chambers.  Mayor Robert D. Coble called the meeting to order at 10:25 a.m.  Council members present were: The Honorable Jim Papadea, The Honorable Anne M. Sinclair, The Honorable Hamilton Osborne, Jr. and The Honorable Sam Davis.  Absent were The Honorable E.W. Cromartie, II and The Honorable Francenia B. Heizer.   Also attending were Ms. Leona K. Plaugh, City Manager and Ms. Pamela J. Ferst, Acting City Clerk.

1. APPROVAL OF MINUTES

Upon motion by Mr. Osborne, seconded by Mr. Davis, Council voted unanimously to approve the minutes for August 1, 2001;  August 22, 2001;  August 29, 2001; September 12, 2001 and October 31, 2001.  Ms. Sinclair was not present for the vote.

2. PRESENTATIONS

A. Proposed Rule on the Use of Locomotive Horns - Mr. Charles T. Ferillo, Jr.

Mr. Charles T. Ferillo, Jr. presented the Proposed Rule on the Use of Locomotive Horns.  Mr. Ferillo and other supporters would like for Council to consider establishing a quiet zone in the Gramby, Olympia, Whaley, Wales Garden, Hollywood-Roseville, Wheeler Hill, University, Martin Luther King and Waverly neighborhoods.

Mr. Bob Gates, Granby Neighborhood resident, urged Council to adopt a local horn ban. Mr. Gates stated that removing the railroads from the Vista area has created more train traffic in his neighborhood.  Mr. Granby has studied the expense and the impact of adopting this ban and will share his findings with the City Attorney.

Upon motion by Ms. Sinclair, seconded by Mr. Papadea, Council voted to authorize the City Manager to proceed with the proposal process and come back with a cost estimate citywide.

III. PUBLIC HEARING

Mayor Coble opened the Public Hearing at 10:45 a.m.

1. ZONING MAP AMENDMENTS

1. 01-26 MA. 3500 block Oscar Street, TMS 11616-03-17, rezone from D-1 to RD (request was originally for RG-1).

Mr. John Blackmon, applicant, is converting this single family lot into three (3) individual lots.
 
Mr. James Middleton, 2027 Worthy Drive and the resident of 3504 Oscar Street appeared in opposition to this re-zoning request.

This item was held over, no action was taken.

2. 01-28 MA.  Properties bounded by Gadsden Street on the West; Lincoln Street on the East; Blossom Street on the South and Senate Street on the North.  Proposed arena & conference center, TMS 8914-4-1,2,3; 8915-11-1,2; 8915-5-1 thru 6; 8915-3-1; and 8916-11-4p, rezone from M-2, DD to PUD-C,DD.

Upon motion by Mr. Papadea, seconded by Ms. Sinclair, Council voted unanimously to approve 01-28 MA.  Properties bounded by Gadsden Street on the West; Lincoln Street on the East; Blossom Street on the South and Senate Street on the North.  Proposed arena & conference center, TMS 8914-4-1,2,3; 8915-11-1,2; 8915-5-1 thru 6; 8915-3-1; and 8916-11-4p, rezone from M-2, DD to PUD-C,DD.

The following properties have been annexed into the City of Columbia with no zoning change.  This action is for confirmation of zoning classification only.

Upon motion by Mr. Papadea, seconded by Ms. Sinclair, Council voted unanimously  to approve on a single motion Zoning Map Amendment Items 3. through 14.

3. 01-27 MA. 3409 Park Street, TMS 09106-02-05, confirm RG-2 zoning.

4. 01-28 MA. 608 Oakland Avenue, TMS 11707-2-43, confirm RS-2 zoning.

5. 01-29 MA. 2301 Apple Valley Road, TMS 7502-01-16, confirm RG-1 zoning.

6. 01-30 MA. 3307 Lyles Street, TMS 09106-03-06, confirm RG-2 zoning.

7. 01-31 MA. 1114 & 1118 Greenlawn Drive, TMS 16414-09-01 (confirm C-3 zoning) and TMS 16414-09-09 (confirm C-1 zoning).

Mayor Coble called the Public Hearing to a close at 10:55 a.m.

IV. CONSENT AGENDA

Upon motion by Mr. Papadea, seconded by Ms. Sinclair, Council voted unanimously to approve on a single motion Consent Agenda items A. 1. and B. 3. through 5.

1. STREET CLOSINGS

1. Request from Yesterday's, The Knock Knock Club, Bar None, Sharky's, Rafters, The Flipside and Fat Alleys to close the 600 Block of Harden Street between Blossom Street and Devine Street and the adjacent 700 block of Santee Avenue between Harden Street and Blossom Street, on Monday, December 31, 2001, from 6:00 p.m. - 2:30 a.m., Tuesday, January 1, 2002.  This request is made to accommodate the 2nd New Years Eve Celebration in Five Points.  Contact: Scott Linaberry Approval of Resolution No.: R-2001-080 - Authorizing consumption of alcoholic beverages and New Years Celebration. - Approved

B. ORDINANCE - SECOND READING

1. ORDINANCE NO.:  2001-104 - Authorizing issuance and sale of    $25,000,000 tax increment bonds, Series 2001, of the City of Columbia,   South Carolina for the purpose of paying the cost of certain redevelopment
projects;  fixing the form and details of the bonds, limiting the payment of the bonds from the sources provided herein;  providing for the disposition for the proceeds thereof;  and other matters relating thereto.  First reading was given on October 31, 2001.  - Approved on second reading.

Upon motion by Mr. Papadea, seconded by Ms. Sinclair, Council voted unanimously to approve Ordinance No.:  2001-104 - Authorizing issuance and sale of $25,000,000 tax increment bonds, Series 2001, of the City of Columbia, South Carolina for the purpose of paying the cost of certain redevelopment projects;  fixing the form and details of the bonds, limiting the payment of the bonds from the sources provided herein;  providing for the disposition for the proceeds thereof;  and other matters relating thereto.  Mr. Osborne abstained from voting due to a conflict of interest.

2. Ordinance No. 2000-039 - Amending Code of Ordinances of the City of  Columbia, South Carolina, Chapter Public Nuisance.  Approved on first reading   June 06, 2001.  - Approved during the work session.

3. Ordinance No.: 2001-100 - Granting temporary encroachment to Pam   Harpootlian at 1721 Enoree Avenue.    Approved on first reading November 07,   2001.  - Approved on second reading

4. Ordinance No.: 2001-101 - Granting encroachment to Wayne Wickers d/b/a   Chef Wayne's New York City Hotdogs for a cart at the Southern corner of   Hampton and Assembly Streets.  Approved on first reading November 07,   2001.    - Approved on second reading
 
5. Ordinance No.: 2001-087 - Annexing 3941 Farrow Road, Richland County TMS #11606-07-08.  Approved on first reading October 17, 2001.    - Approved on second reading

V. RESOLUTIONS

Resolution R-2001-077 - Authorization for Acceptance of Dedication of Street known as Woodcreek Farms Road, Parcel "A" in Woodcreek Farms Subdivision; Richland County TMS #28900-03-07, City File #222-22

Upon motion by Mr. Osborne, seconded by Mr. Papadea, Council voted unanimously to approve Resolution R-2001-077 - Authorization for Acceptance of Dedication of Street known as Woodcreek Farms Road, Parcel [email protected] in Woodcreek Farms Subdivision; Richland County TMS #28900-03-07, City File #222-22.

VI. TRAFFIC ISSUE

All-Way Stop at Kalmia Drive, Wilmot Avenue and Duncan Street

Upon motion Mr. Papadea, seconded by Ms. Sinclair, Council voted unanimously to approve the request for an All-Way Stop at Kalmia Drive, Wilmot Avenue and Duncan Street.

VII OTHER MATTERS

Appeal Request for a Chauffeurs License - Mr. Andre Watkins

This item was held over, no action was taken.

VIII. APPEARANCE OF PUBLIC HAVING BUSINESS WITH CITY COUNCIL

Ms. Eunice McAllister, Riverhill Condominiums, appeared before Council to express her concerns regarding the fire code that is being enforced by Mr. John Reich, Fire Marshall.  Ms. McAllister stated that the incorrect code is being enforced.

Mayor Coble requested that the Construction Board of Adjustments and Appeals look into the situation.
