CITY OF COLUMBIA CITY COUNCIL MINUTES
WEDNESDAY, September 13, 2000
 

The City of Columbia City Council met Wednesday, September 13, 2000, at 10:00 a.m. in the City Hall Council Chambers, 1737 Main Street, Columbia, South Carolina, for a Rezoning Public Hearing and other matters.  Mayor Robert D. Coble called the meeting at 10:10 a.m.  Council members present were: The Honorable E.W. Cromartie, The Honorable Francenia B. Heizer, The Honorable Jim Papadea, The Honorable Anne M. Sinclair,  The Honorable Hamilton Osborne Jr., and The Honorable Sam Davis.  Also attending was Mr. Michael A. Bierman, City Manager and Ms. Peggy S. Breeland, City Clerk.

I. ROLL CALL

Council members present for roll call:  The Honorable E.W. Cromartie, The Honorable Jim Papadea, The Honorable Anne M. Sinclair, The Honorable Hamilton Osborne, Jr., and The Honorable Sam Davis,  Note Ms. Heizer arrived at the meeting at 10:20 am.

Upon request from Mr. James Meggs, City Attorney, Item III.B.1. - First Reading for Ordinance No. 2000-073 -  was added to the agenda.
 
II. PUBLIC HEARING

A. ZONING MAP AMENDMENTS

1. #00-30 MA. 2423 & vacant lot on Cushman Road - TMS 11713-07-05 & 06.  Rezone from
D-1 to C-3.

Mr. Carl Scott asked that the property be rezoned from D-1 to C-3 to erect a convenience store
that will include a pool room, game room, and restaurant located at 2423 Cushman Road and
a adjoining lot.

Mayor Coble opened the meeting for public comment.

Ms. Tillis spoke in opposition to the request asking that the property remain residential.

Mr. Hopkins spoke in opposition to the request.

Mr. Cedric Harrison spoke in opposition to the request and expressed concerns regarding traffic flow and the possible blocking of access to a fire hydrant.

Mayor Coble closed the public hearing on 2423 and adjoining lot on Cushman Road.

Upon motion by Mr. Davis, seconded by Mr. Papadea, Council unanimously voted to deny the request to rezone property at 2324 and adjoining lot on Cushman Road.

2. #00-41 MA. Chellewood Subdivision (portion of Bellclave Subdiv.) - TMS 22715-01-01.
Annexation with rezoning from C-1 (County) to RS-1(City).
 

Mr. Chip Land reviewed the request to rezone a portion of Belleclave Subdivision off Gills
Crossing Road from C-1 to RS-1 to allow the construction of Phase 3C to Belleclave Lake
Subdivision.  This phase will be known as Chellewood Subdivision.

Mayor Coble opened the meeting for public comment.  No one appeared to speak in favor nor against the request.

Upon motion by Mr. Papadea, seconded by Mr. Davis, Council unanimously voted approve the
request to rezone portions of Belleclave Subdivision.

3. #00-34 MA. 724 Beltline Boulevard - TMS 13811-05-32; rezone from RS-1 to C-3.

Mr. Chip Land reviewed the request to rezone 724 Beltline Boulevard from RS-1 to C-3 to allow
the construction of The Columbia Bridge Club on this site.

Mayor Coble opened the meeting for public comment.  No one appeared to speak in favor nor against the request.

Upon motion by Ms. Heizer, seconded by Mr. Osborne, Council unanimously voted to deny the request to rezone 724 Beltline Boulevard.

4. #00-35 MA. 7424 Garners Ferry Rd - TMS 16409-03-05; 16312-02-01(outparcel/Lowes);
rezone from D-1 to C-3.

Mr. Chip Land reviewed the request to rezone 7424 Garners Ferry Road from D-1 to C-3 in order to erect a restaurant (Chick-Fil-A) at this location.

Mayor Coble opened the meeting for public comment.  No one appeared to speak in favor nor against the request.

Upon motion by Mr. Papadea, seconded by Ms. Heizer, Council unanimously voted to approve the request to rezone 7424 Garners Ferry Road to erect a restuarant on this site.

5. #00-37 MA.  1406 Hyatt Avenue - TMS 09215-11-06; rezone from RS-3 to RG-2.

Mr. Derrick Jackson, agent, asked that the property be rezoned from RS-3 to RG-2 to allow the owner, Ms. Olivia Colbert, to operate a boarding house.  Ms. Colbert has been operating this
home for a number of years.

Mayor Coble opened the meeting for public comment.

Mr. Issac Edwards, tennant, spoke in favor of the request.

Mr. Abram Cole, tennant, spoke in favor of the request.

Mr.Kenneth Irby, neighbor, spoke in favor of the request.  Mr. Irby expressed concern regarding the age of the owner and tenants.  He also stated that he was unaware of any complaints in reference to the property located at 1406 Hyatt Avenue.
 

Ms. Fran Potter, spoke in opposition to the request to rezone the property at 1406 Hyatt Avenue.

Mr. Rhett Anders spoke in opposition to the request.  Mr. Anders stated that he would work with the owner in relocating if necessary.

Mayor Coble closed the public hearing on 1406 Hyatt Avenue.
Mayor Coble asked that Leona Plaugh, Jim Meggs, Rhett Anders and other city staff work with the owner to discuss her options.

Upon motion by Mayor Coble, seconded by Ms. Heizer, Council voted to defer action on the request for 30 days.

6. #00-38 MA.  1400 Block Wayne St., TMS 09009-10-01,03(p). rezone from MU-Overlay to
PUD-R.

Mr. Chip Land reviewed the request to rezone the 1400 Block of Wayne Street from MU-
Overlay to PUD-R to allow the development of 36-40 loft condominiums.

Mayor Coble opened the meeting for public comment.  No one appeared to speak in favor nor against the request.

Upon motion by Mr. Osborne, seconded by Ms. Heizer, Council unanimously approved the request to rezone the 1400 Block of Wayne Street.

7. #00-42 MA.  West side Hazelwood Road, TMS 19100-01-02p, 3,4,5; rezone rear portion
from RG-2 to RS-3.

Mr. Chip Land reviewed the request to rezone the west side of Hazelwood Road from RG-2 to RS-3 to divide into 177 lots for single family dwellings.

Mayor Coble opened the meeting for public comment.  No one appeared to speak in favor nor against the request.

Upon motion by Mr. Osborne, seconded by Mr. Papadea, Council unanimously approved the request to rezone the west side of Hazelwood Road.

8. #00-42 MA.  3501 Moss Avenue - TMS 13801-07-16; rezone from RS-3 to PUD-R.

Ms. Paulette Ritter asked that the property be rezoned from RS-3 to PUD-R to allow the use of an existing garage apartment for her marginally handicapped son.

Mayor Coble opened the meeting for public comment.  No one appeared to speak in favor of nor against the request.

Upon motion by Mr. Cromartie, seconded by Mr. Papadea, Council unanimously approved the request to rezone the west side of Hazelwood Road.

9. #00-44 MA.  Barhamville Rd. & Germany St. - TMS 11508-07-09(p); rezone portion from
RG-1 to RS-1.

 
Mr. Chip Land reviewed the request to rezone Barhamville Road and Germany Street from RG-1 to RS-1 to conform zoning to current and desired future use for home ownership.

Mayor Coble opened the meeting for public comment.  No one appeared to speak in favor of nor against the request.

CONFIRM CURRENT ZONING CLASSIFICATION OF RECENTLY ANNEXED PROPERTIES

Mayor Coble opened the meeting for public comment on Items 10 through 24.  No one appeared to speak in favor of nor against the request.

Upon motion by Mr. Cromartie, seconded by Mr. Papadea, Council unanimously approved the requests of Items 10 through 24 on a single motion.

10. #00-45 MA.  6910 Welborn Road - TMS 19203-03-05; Confirm RS-1 zoning.

III. ORDINANCES

A. SECOND READING

1. Ordinance No. 2000-071 - Granting encroachment to the University of South Carolina for
a pedestrian overpass over Blossom Street and Park Street and a pedestrian overpass
over Assembly Street at Wheat Street.  First Reading was September 6, 2000.

Upon motion by Mayor Coble, seconded by Mr. Papadea, Council voted four to one to approve second reading on Ordinance No. 2000-071.  Voting aye were Mr. Osborne, Mr. Papadea,
Ms. Heizer, and Mayor Coble.  Voting nay was Ms. Sinclair.

Upon motion by Mr. Cromartie, seconded by Mr. Papadea, Council unanimously voted to give
second reading approval to Items 2 through 6 on a single motion.
 

2. Ordinance No. 2000-064 - Prohibiting parking in certain areas on the 1900 block of Park
Street, the 900 block of Richland Street, the 1900 block of Lincoln Street and the 900
block of Calhoun Street.

Council gave second reading approval to Ordinance No.2 000-064.

3. Ordinance No. 2000-065 - Amending interim zoning designation of Ordinance No. 2000-
04 - annexing parcels on the North and South sides of Buckler Road and Parcel B, known
as Richland County T.S. #09315-02-02, 03 and 04, 09316-03-05 and Parcel B adjacent to
09316-03-05 was enacted on May 3, 2000 with an interim zoning designation of C-3.  First
reading was September 6, 2000.

Council gave second reading approval to Ordinance No. 2000-065.

4. Ordinance No. 2000-066 - Annexing 7 Jacobs Mill Court, Lot 33, Block D4 & D4A, Wood
Creek Farms, Richland County T.S. #28901-01-01.  First Reading was September 6,
2000.

Council gave second reading approval to Ordinance No. 2000-066.

5. Ordinance No. 2000-067 - Annexing Chellewood Subdivision, Phase 3C, portion of
Richland County T.S. #22715-01-01.  First Reading was September 6, 2000.

Council gave second reading approval to Ordinance No. 2000-067.

6. Ordinance No. 2000-069 - Authorizing sale of 1705 German Street, Richland County T.S.
No.: 11512-02-02 to Ronald Taylor.   September 6, 2000.

Council gave second reading approval to Ordinance No. 2000-069.

B. ORDINANCES - FIRST READING

1. Ordinance No. 2000-073 - Amending the 1998 Code of Ordinances of the City of
Columbia, South Carolina, Chapter 23, Utilities and Engineering, Article IV, Wastewater
Service, sec. 23-103, Discharge of industrial waste, (g) General guideline to amend
subparagraph (12) Organotins.

Upon motion by Mayor Coble, seconded by Mr. Cromartie, Council unanimously voted to give
first reading approval to Ordinance No. 2000-073.

IV. STREET CLOSINGS

Upon motion by Mr. Cromartie, seconded by Ms. Sinclair, Council unanimously voted to approve Items 3 through 4 on a single motion.

1. Request from Columbia Inferno, to close Lincoln Street from Lady Street (in front of
Willy’s) and halfway down Lincoln Street (up to the Blue Marlin) for their “SEC Fan Jam”,
between the hours of 5:00 p.m. thru Midnight on the following Friday evenings: September
22nd, October 13th, and October 27th.

This item was held over.
 
2. Request from Palmetto Place Children’s Emergency Shelter to close the 1200 block of
Lincoln Street and Approval of Resolution No. 2000-050 authorizing the sale and
consumption of alcoholic beverages and denying use of coolers, glass containers and the
presence of pets, for the SEC Fan Jam, between hours of 5:00 p.m. until 1:00 a.m. on the
following Friday evenings: September 22nd, October 13th, and October 27th.

This item was held over.

3. Council approved the request from Gilbert Memorial Baptist Church to close 800 Bay
Street at 1800 Mitchell Street and 1900 Mitchell at 800 S. Edisto Avenue for their annual
street carnival on Saturday, September 16, between the hours of 9:00 a.m. thru 5:00 p.m.

4. Council approved the request from The University of South Carolina, to close Greene
Street between the gates located in front of the Russell House University Union at 1400
Greene Street, for the Homecoming Kickoff Concert and Fireworks Display on Tuesday,
September 19, 2000, between the hours of 6:00 p.m. and Midnight.

5. Council approved the request from Belleclave Homeowner’s Association to close one
block of street Wildeoak Trail, between Belleclave Road and High Knoll Road for their
annual Association Party, on Saturday, September 23, 2000, between the hours of 2:30
p.m. thru 10:00 p.m.

6. Council approved the request from Incarnation Lutheran Church to close Kirkwood
Avenue for their annual Kid’s Festival, on Saturday, September 23, 2000, between the
hours of 2:00 p.m thru 6:00 p.m.

V. APPEARANCE OF PUBLIC HAVING BUSINESS WITH CITY COUNCIL

No one appeared to speak before Council at this time.

Upon motion by Mayor Coble, seconded by Mr. Cromartie, Council unanimously voted to go into executive session at 11:45 am to receive a legal briefing on contract and legal matters.
Mr. Osborne will not participate in any discussion related to SCANA.

The meeting was adjourned at 12:30 pm.
