CITY COUNCIL CHAMBERS

The City of Columbia City Council met in regular session on Wednesday, April 17, 2002, in the City Hall Council Chambers, 1737 Main Street, Columbia, South Carolina.  Mayor Robert D. Coble called the meeting to order at 10:14 a.m.  Council members present were The Honorable E.W. Cromartie, II, The Honorable Francenia B. Heizer, The Honorable Jim Papadea, The Honorable Anne M. Sinclair and The Honorable Sam Davis.  Absent was The Honorable Hamilton Osborne, Jr.  Also present were Ms. Leona K. Plaugh, City Manager and Ms. Pamela J. Ferst, Acting City Clerk.

APPROVAL OF MINUTES

1. Minutes of March 20, and March 27, 2002

Upon motion by Mr. Papadea, seconded by Mr. Cromartie, Council voted unanimously to approve the minutes of March 20 and 27, 2002.

PRESENTATIONS

2. March Employee of the Month - Ms. Susan Leitner, Engineering Technician III

Mr. David Johnson, Director of Engineering, introduced Ms. Susan Leitner, Engineering Technician III, as March Employee of the Month.  Ms. Leitner has been employed with the City of Columbia for thirteen (13) years.  Ms. Leitner was recognized for providing efficient and professional service as a project coordinator throughout the City.

CONSENT AGENDA

Upon motion by Mr. Cromartie, seconded by Mr. Papadea, Council voted unanimously to approve, on a single motion, Consent Agenda Items 3. through 13.  Item 14. was held over, no action was taken.

STREET CLOSING REQUESTS

3. Council is asked to approve a request to close the 500 block of Capitol Place, on Friday, May 17, 2002, from 6:15 p.m. until 10:30 p.m. for a neighborhood block party.  Approved

4. Council is asked to approve a request from The Township to close the 1600 block of Blanding Street on Friday, April 26, 2002 at 6:00 a.m. until Saturday, April 27, 2002 at 11:00 p.m. for pedestrian and booth traffic at a Barbecue Cookout.  Approved

CONSIDERATION OF BIDS, AGREEMENTS, AND CHANGE ORDERS

5. Council is asked to approve the purchase of a One Ton Dump Truck, as requested by the Street Division.  Award 1 - 11,000 GVWR Cab & Chassis to Pulliam Motor Co., the low bidder, in the amount of $22,751.50 and 1 - 2 to 3 Cubic Yard Dump Body to Lee Transport, the low bidder, in the amount of $5,722.50.  For a total amount of $28,474.00.  Pulliam Motor Co. is located in the City and Lee Transport is located in Richland County.  The truck chassis and body will be purchased using the S.C. State Vehicle Contract.  There are no MBE/FBE vendors who sell this vehicle at this price.  Approved

6. Council is asked to approve the purchase of 1 Lot of HVAC Equipment and Installation to replace the HVAC Unit at Wastewater Maintenance Division Office as requested by the Wastewater Division.  Award to Piedmont HVAC, the lo bidder in the amount of $28,000.00.  Piedmont is located in West Columbia, SC.  Bid requests were sent to six MBE's with two responses.  Approved

7. Council is asked to approve the purchase of Computer Software Neatsuite for 1000 users, as requested by Information Technology.  Award to Softmart Government Services, Inc., the lowest quote, in the amount of $19,242.42.  No  MBE/FBE participation.  This is an out of state vendor.  No local vendors are resellers of this product.  Approved

8. Council is asked to approve Change Order #1 to the Columbia Canal Water Treatment Plant Improvements, Project #W604E (Remaining) to excavate approximately 5,000 Cubic Yards @ $80/cubic yard, and rock drilling for piles, as requested by Utilities .  Award to Republic Contracting Corp., in the amount of $690,395.00 making the revised contract price $26,660,095.00.  No MBE/FBE participation.  The company is locally owned and operated.  Approved

ORDINANCE - SECOND READING

9. Ordinance No. 2001-068 - Annexing 76.60 acres, Percival Road at Clemson Road Extension, Richland County TMS #25600-04-12 Approved on first reading April 10, 2002.  Approved on second reading.

10. Ordinance No.: 2002-014 - Annexing Lot on N/S Adams Grove Road, Richland County TMS #11503-06-09.  Approved on first reading April 10, 2002.  Approved on second reading.

11. Ordinance No.: 2002-015 - Annexing Richland County TMS 05200-03-09 and 10, two parcels on Peachtree Drive at Chestnut Hill Subdivision.  Approved on first reading April 10, 2002.  Approved on second reading.

12. Ordinance No.:  2002-016 - Amending the 1998 Code of Ordinances of The City of Columbia, South Carolina, Chapter 22, Streets, Sidewalks and Other Public Places, Article III, Obstructions, Sec. 22-71, Prohibited; removal.   Approved on First Reading March 06,2002.  Approved on second reading.

13. Ordinance No.:  2002-017 - Amending the 1998 Code of Ordinance of The City of Columbia, South Carolina, Chapter 12, Article II, Stopping, Standing, and Parking, Division 1, Generally, Sec. 12-42, Storage of commercial vehicles on streets.    Approved on First Reading March 06,2002.  Approved on second reading.

14. Ordinance No.: 2002-023 - Amending the 1998 Code of Ordinance of the City of Columbia, South Carolina, Chapter 5, Article II, Building and Technical Codes, to add Division 9, International Residential Code for One (1) and Two (2) Family Dwellings, Sec. 5-191, Adoption; conflicting provisions.  Approved on first reading April 10, 2002.
 This item was held over, no action was taken.

ORDINANCE - FIRST READING

Upon motion by Mr. Cromartie, seconded by Mr. Papadea, Council voted unanimously, on a single motion, to give first reading approval to Items 17. through 25., with the exception of Items 15, 16 and 21.

15. Ordinance No.: 2002-021 - Granting encroachment to Mitch and Lisa Newman for construction, installation and maintenance of a lattice brick wall with wrought iron driveway gate along the property boundaries of 3529 Wilmot Avenue at Bonham Street.
 This item was held over, no action was taken.
 
16. Ordinance No.: 2002-024 - Annexing 0.24 acre, Key Road and 0.04 acre, Bluff Road at National Guard Road, Richland County, TMS #11210-01-15 and 11205-01-11.
 This item was held over, no action was taken.

17. Ordinance No.: 2002-025 - Annexing South Beltline Boulevard, Richland County TMS #13805-05-26.  Approved on first reading.

18. Ordinance No.: 2002-026 - Annexing 1624 Broad River Road, Richland County TMS #70308-02-15.  Approved on first reading.

19. Ordinance No.: 2002-027 - Granting encroachment to Gracie's for outdoor dining at 711 Harden Street.  Approved on first reading.

20. Ordinance No.: 2002-028 - Granting encroachment to Friendship Baptist Church for  placement and maintenance of directional signs.  Approved on first reading.

21. Ordinance No.: 2002-031 - Granting encroachment to Columbia Development Corporation for canopy overhang in the 1200 block of Lincoln Street between Gervais Street and Lady Street.

22. Ordinance No.: 2002-032 - Annexing 201 Lost Creek Drive, Lot 3, Lost Creek Plantation, Richland County TMS #05114-04-01.  Approved on first reading.

23. Ordinance No.: 2002-033 - Annexing Lot 16, Lost Creek Plantation, Richland County
 TMS #05100-03-89 (portion).  Approved on first reading.
 

24. Ordinance No.: 2002-034 - Annexing 7712 and 7720 Leitner Drive, Richland County TMS #19206-09-77 and 79.  Approved on first reading.

25. Ordinance No.: 2002-035 - Annexing 3337 Park Street, Richland County TMS #09106-02-04.  Approved on first reading.

26. Ordinance No.: 2002-036 - Authorizing City Manager or First Assistant City Manager to execute Addendum #3 to the Contract for Sale with Avant Developments, LLC for the transfer of approximately 15.31 acres on Pelham Drive, Richland County TMS #13715-01-02 (eastern portion), and to create an easement in favor of Avant Developments, LLC.

Upon motion by Mr. Cromartie, seconded by Mayor Coble, Council voted unanimously to approve Ordinance No.: 2002-036 - Authorizing City Manager or First Assistant City Manager to execute Addendum #3 to the Contract for Sale with Avant Developments, LLC for the transfer of approximately 15.31 acres on Pelham Drive, Richland County TMS #13715-01-02 (eastern portion), and to create an easement in favor of Avant Developments, LLC.  Mr. Papadea abstained from voting do to a conflict of interest.

RESOLUTIONS

27. Resolution R-2002-020 - Authorizing City Manager to place confiscated or unclaimed property to City use.

A motion made by Mr. Cromartie, seconded by Mr. Davis, to approve Resolution R-2002-020 - Authorizing City Manager to place confiscated or unclaimed property to City use was substituted with a motion by Ms. Heizer, seconded by Ms. Sinclair, to withdraw Resolution R-2002-020 and authorized:

Ø Staff to draft an ordinance that states that abandoned property in the possession of the Police Department or any other City department be brought to City Council by Resolution on a quarterly basis.
Ø Notification to the public by a listing of the property published on the web and posted at City Hall.
Ø That a disposition process be established under the direction of the City Manager.

Council voted unanimously on the substitute motion.

28. Resolution - (Southeastern Vista District Infrastructure) - Relating to the declaration of intent by the City of Columbia, South Carolina, to reimburse certain expenditures prior to the issuance by the City of its tax-exempt obligations.

Upon motion by Mr. Cromartie, seconded by Mr. Davis, Council voted unanimously to approve Resolution  - (Southeastern Vista District Infrastructure) – Relating to the declaration of intent by the City of Columbia, South Carolina, to reimburse certain expenditures prior to the issuance by the City of its tax-exempt obligations.  Ms. Heizer abstained do to a conflict of interest.

APPEARANCE OF PUBLIC HAVING BUSINESS WITH CITY COUNCIL

Mr. Don Thurmond, Pope Davis, appeared before Council to request reimbursement for his damaged vehicle and glasses.  He told Council that on February 5, 2002, his car hit an unsecured manhole causing the car to catch fire.  Mr. Thurmond stated the car was valued at $4,400 and his glasses cost $325.

Mr. Bill Manley, appeared before Council to request assistance with the purchase of property at the corner of Washington Street and Gadsden Street near Memorial Park.  Mr. Manley suggested that this property be used for parking because parking is limited in and around Memorial Park.

Ms. Alta Milling, Legionnaire, appeared before Council in favor of purchasing the property on the corner of Washington Street and Gadsden Street and to form a Memorial Park Advisory Committee.

Upon motion by Mayor Coble, seconded by Mr. Cromartie, Council voted unanimously to approve the formation of a Memorial Park Advisory Committee consisting of ten (10) Veteran representatives and five (5) representatives from City Council, the church and Arsenal Hill.

Brian with the Department of Mental Health, invited Council to the Department of Mental Health’s “Art in the Park” as part of the Mental Health Awareness Walk and Rally, on Saturday, April 27, 2002, at 10:00 a.m.

Mayor Coble adjourned the meeting at 10:56 a.m.
